General User Terms
- BACKGROUND
- These general terms and conditions (”Terms”) apply to the provision and User’s use of the electronic procurement tool e-Avrop (”Service”) and the website operated by Antirio AB (”Company”). These Terms of Use, as well as any additional annexes attached to the Terms, are collectively referred to as ”Terms of Use”. All definitions that begin with a capital letter in these Terms and Conditions shall have the same meaning in the other appendices, unless otherwise expressly stated in the context. The service is only intended for you who are employees and or representatives of a tenderer. These Terms apply to all use of the Service and the Website. In order to access the Service, you must accept these terms. Please read the terms carefully before you start using the service. You accept the terms by starting to use the Service.
- THE SERVICE
- To register a user account, after being assigned one, you must provide certain personal data (such as name, e-mail address, telephone number, etc.) and fill in information about the Bidder and/or company name. You are responsible for ensuring that the information you provide when creating a user account is complete, truthful and accurate and that it is kept up to date. The company may check that the information provided regarding bidders and organization numbers is consistent with public registers. The company reserves the right to remove obviously incorrect information without prior notice. When registering, you must choose a personal password that meets the Company’s security requirements for passwords. The password is required to log in to the Service. Your password must be kept secret and stored securely. If your password is lost or stolen, or if you have reason to believe that someone unauthorized has gained access to your user account, you must immediately notify the Company and change your password. By registering a user account and starting to use the Service, you confirm and accept these Terms, and confirm that you have received information about our processing of your personal data in accordance with what appears on the Website and the Company’s personal data policy. To be able to use the Service, access to a computer and internet is required. The security requirements applicable at any given time can be found on the website.
- USE OF THE SERVICE
- You are responsible for all actions taken under your user account. You should ensure that you have your own anti-virus program and take other appropriate security measures when using the Service. You may only use the Service for the purposes stated in these Terms. The data, documentation and other material that you receive via the Service may not be transferred, sub-licensed or otherwise made commercially available to third parties. You may not abuse the Service by introducing viruses, trojans, internet worms, logic bombs or other material that is intended to cause harm or is otherwise technically harmful. You must not attempt to gain unauthorized access to the Service, the server on which the Service is stored or any server, computer or database connected to the Service. You may also not attack the system through Denial of Service attacks, including but not limited to overload attacks. Violation of any of the above may constitute a violation of the law and e-Avrop will report such violations to the authorities. In case of violation of the above, your right to use the Service will immediately cease and the Company has the right to immediately block your user account and to block you from creating a new user account.
- E MAIL
- The company may send information of an advertising nature, such as information about planned courses, as well as inform about events of importance for the use of the Service, such as planned maintenance, provided that you do not object to such mailings. The above information will be sent to the email address you provided during registration. You can unsubscribe from these mailings at any time by logging in to the Home Page. If you choose to unsubscribe from mailings, you can monitor information about events of importance for the use of the Service on the Home page. The company is not responsible for missing information about events of importance for use of the Service.
- AGREEMENT TERM AND TERMINATION
- These Terms of Use apply indefinitely from the time you have gained access to the Service. If your employment or assignment ends or the tenderer revokes your access to the Service for any other reason, you are obliged to delete your user account. The Company has the right to suspend your access to the Service in whole or in part, temporarily or permanently if you violate these Terms of Use, law or regulation. If your user account is inactive for more than one (1) year, the Company will terminate your user account after a written notification to the email address you have registered.
- SECRECY
- The underlying programs and methods of the Service constitute the Company’s trade secrets and are subject to confidentiality, as are company-internal information about the Company. To the extent permitted by mandatory law, you undertake not to disclose or in any way exploit confidential information that you obtain through the use of the Service. You do not have the right, without the Company’s express written permission, to publish or in any other way make public reports or other material or information that the Company has prepared and which you received or took part in through the Service. You must also otherwise handle the Company’s systems and methods with the necessary discretion. The confidentiality obligation applies even if the Service has otherwise ceased.
- AVAILABILITY
- The service is normally available 24/7. However, the company cannot guarantee that the Service’s availability will be uninterrupted or error-free. The Service may from time to time be completely or partially unavailable while performing necessary backups, maintenance, improvements, security updates or similar actions. As a general rule, the Company will inform about such planned interruptions via website or via email. All necessary maintenance will primarily be carried out outside office hours. If the Service should be unavailable, interrupted or affected by errors, for whatever reason, you are not entitled to any compensation of any kind. The only action that the Company is obliged to take if the Service is not available is, within such time as the Company deems reasonable, to initiate fault-remedial measures, if this is possible.
- CHANGES
- The Company may from time to time make changes to these Terms. In the event of significant changes to these Terms and Conditions that are detrimental to you, the Company will, to the extent possible, inform you before the changes take effect. If you do not agree to the changes, you can terminate the Service at any time by deleting your user account in accordance with the clause.
- COMPLETE REGULATION
- The Terms of Use constitute the Company and your complete settlement of all matters relating to the Service. All written or oral commitments and declarations that preceded the Terms of Use shall be replaced by the content of the Terms of Use.
- TRANSFER OF RIGHTS
- You may not fully or partially assign or pledge your rights and/or obligations under these Terms of Use without the Company’s prior written approval.
